Intellectual Property Rights (IPR) Policy

1.0 PREAMBLE
In the age of globalization, knowledge holds paramount importance, and universities serve as the primary sources of knowledge creation and dissemination. Silver Oak University, with its spanerse community of educators, researchers, and students, actively contributes to developing new technologies and innovations. The university believes these innovations should benefit society, not just remain theoretical. Silver Oak University fosters a research culture, supported by robust facilities and an environment that encourages creativity. This Intellectual Property Rights (IPR) Policy aims to protect and regulate the interests of innovators.
2.0 OBJECTIVES
This IPR Policy has been framed in order to achieve the following objectives:

Awareness and Environment: Promote awareness about intellectual property among faculty and students, fostering a research-driven environment.

Empowerment and Protection: Empower researchers to innovate and protect their intellectual property rights effectively.

Commercialization Support: Assist in commercializing inventions while safeguarding interests of innovators and the university.

Industry Collaboration: Encourage faculty to engage in consultancy and sponsored research projects with industries and funding agencies.
3.0 SCOPE
This policy applies to all faculty, staff, students, and collaborators of SILVER OAK UNIVERSITY involved in the creation of intellectual property.
4.0 DEFINITION OF INTELLECTUAL PROPERTY
Intellectual Property (IP) includes, but is not limited to:

Patents

Trademarks

Copyrights

Industrial designs

Trade secrets

New plant varieties

Geographical indications
5.0 DISCLOSURE OF THE INTELLECTUAL PROPERTY
Creators are required to promptly disclose any potential intellectual property to the IPR Cell of SILVER OAK UNIVERSITY.

The IPR Cell will assess each disclosure to determine ownership and assess its potential for protection.
6.0 POLICY REVIEW AND AMENDMENTS
The IPR Policy will be reviewed periodically by the IPR Cell and amended as necessary to ensure compliance with current laws and regulations.

Any amendments to the policy will be communicated to all stakeholders.
7.0 COMMERCIALIZATION OF INTELLECTUAL PROPERTY
The university encourages the commercialization of IP through licensing, joint ventures, or startup.

Revenue generated from commercialization will be shared between the university and the creators as per the revenue-sharing policy.
8.0 GUIDELINES FOR THE INCUBEES, STUDENTS AND FACULTY MEMBERS
All individuals or teams working under the university's incubation centre (referred to as "Incubees") shall be bound by the following conditions

Any intellectual property (IP) generated during the incubation period, using university resources or mentorship, shall be co-owned by the incubator and the university unless otherwise agreed upon in writing.

Incubees are required to sign an agreement detailing the IP sharing model prior to the initiation of any project.

All IP rights generated by the Incubees must follow the guidelines established by Silver Oak University's IPR policy and must not violate third-party rights or engage in plagiarism or unauthorized use of external IP.

Mandatory Registration of Patents and Startups:

Any patent filed, intellectual property created, or startup launched by students, faculty, or researchers within Silver Oak University, using the university's resources, guidance, or funding, must be registered under the name of Silver Oak University.

The university will hold ownership or co-ownership rights for such patents or startups, and a clear revenue-sharing agreement will be made, ensuring a fair distribution of benefits between the creator(s) and the university.
9.0 CONFLICT OF INTEREST
The inventors must disclose any conflicts of interest and furnish a certificate affirming the absence of any conflicts of interest related to the invention/technology in question.
10.0 INFRINGEMENT, LIABILITY AND INDEMNITY INSURANCE
The policy covers patents, trademarks, copyrights, industrial designs, trade secrets, new plant varieties, and geographical indications.

These categories represent the spectrum of intellectual property protected under the policy.
11.0 DISPUTE RESOLUTION
In case of any dispute regarding the intellectual property in question, the aggrieved party may appeal to the President, whose decision shall be final and binding.
12.0 CONFIDENTIALITY
All members of the university community must maintain confidentiality regarding IP disclosures and related matters.
13.0 TRAINING AND AWARENESS
The university will organize regular IPR workshops and training sessions for faculty, staff, and students.
14.0 EFFECTIVE DATE
This policy will come into effect on 15/07/2019 and will be applicable to all IP created from this date onwards.
